  • More measures against VAT fraudMore measures against VAT fraud.

New measures to cushion the bullying to the possible fraud and swindler allowed, according to Treasury figures, 2009 decreased to 294 million euros, a figure that given the evolution of 2010 also may fall slightly. For now, however, in the first six months of the year the Treasury has emerged 130.4 million euros, representing a 3% increase over the 126 million discovered in the same period of 2009.

The biggest culprits are the usual suspects. VAT fraud in the re-imposed on the rest loosely stem taxes (income tax and societies). Nevertheless, tax evasion in the tax on consumption decreases from 41 to 39 million in the first half. Debt falls somewhat more exposed in the Income Tax. Worst outcome is the tax paid by companies for their profits. Upwelled Debt Companies in the area increases from 16 to 19 million. Fraud grows further identified due to reports of coercion. Spend 37 to 44 million. The explanation is simple: the area where it makes the greatest number of performances: about 22,000 in the first six months of the year, compared to 15,000 a year ago.

A time to take stock of actions carried out 45,352 to June (mean 7,000 more), the Treasury has placed special emphasis on 466 relevant inspections. In the list, the VAT fraud and real estate again occupy the top positions.

Unable to hide a certain satisfaction, the Treasury points out that in the current legislature will have emerged about a billion euros, of which 70% are recovered instantly.

The comparison with the neighboring farms also agrees with the team led by Deputy Treasury Pello González. If you divide 294 million emerged in 2009 among the 700,000 inhabitants of Gipuzkoa, Gipuzkoa discovered by debt amounts to 420 euros. In the case of Biscay, flourished 180 million people divided among 1,152,000 reflect an average of 180 euros, the same as in the state (8.119 million from 45 million Spanish). In Álava, the result hardly varies: 55 million divided by 315,000 equals Alava EUR 183 per inhabitant per year.

  • Requirements to be considered for the application of the deduction in respect of export activities.

According to previous rulings of the Court, are entitled to deduct investments in the strict sense, as investments in tangible or intangible assets of branches and permanent establishments, such as investments in the acquisition of shares in the capital of companies resident in Spanish as well as expenditure.

But in any case, the requirement of the direct link to the export activity is identical. This is because this deduction is one of the methods of deduction scheme is implemented investments in the corporation tax as a major incentive to encourage the formation of national wealth through direct corporate investment, specifically, it seeks to stimulate introduction of Spanish companies abroad, to the extent that investments abroad are directly related to the export of goods and services produced in Spanish territory

  • The labor market adjustment boosts productivity in SpainThe labor market adjustment boosts productivity in Spain.

If you're among the lucky ones who have not lost their jobs following the economic crisis is likely to have noticed an increased workload. The facts are evident: the gross value added has fallen much less than the number of hours worked, which means that workers who remain on the market are more productive than three years ago. Not surprisingly, productivity has grown since the crisis began a 2.63% yearly, compared to the fall of 0.46% in the euro zone. An opposite trend than in the previous boom period, when it grew by only half a year, one third of the euro area.

Recent statistics from Eurostat findings lead to rather striking: Last year, productivity per worker in Spain ten points exceeded the EU average and in seven of the German export superpower, but remain above France. It is clear that the surge in productivity is due to economic adjustment has focused on employment, with a loss of hours worked (4%) was higher than the European (1.4%). But, conversely, also the low productivity of the decade-long boom was due to integration into the labor market more than seven million people. So, leaving aside the dramatic social consequences of the loss of two million jobs, the setting has demonstrated competitive unrecognized in the Spanish economy, which has destroyed less activity than Europe with a greater reduction in hours worked.

José Carlos Diez, chief economist Intermoney, remember that the income per capita, after nearly two years of recession, remains above the European average andin countries like Italy . "That statistic, along with productivity, shows that despite our proverbial pessimism, the Spanish will be in the future what we want to be".

Matilde Mas, co-author of the monograph Productivity: an international perspective and sector of the BBVA Foundation and the IVIE, moderate optimism alluding to the tight labor market: "In Europe they made the adjustment in quantities and prices. In Spain, wages have grown out of the market to low-skilled employees, and only job has been set, "said the professor also at the University of Valencia.

  • An error forced to cancel VAT settlements of over 5,000 millionAn error forced to cancel VAT settlements of over 5,000 million.

The group of technicians from the Ministry of Finance (Gestha) has said that a failure of the tax has caused the Central Economic and Administrative Tribunal (TEAC) has declared void the settlement of VAT for the years 2006, 2007 and 2008 (not prescribed) and settlements from prior years that are under appeal and pending final judgments. These settlements reached a total of 5,100 million.

According to the group, resolution of the TEAC, which affects about 480,000 records, is motivated by an error in the working system of the Tax Agency, which has seen the calendar year as the VAT accounting period when the Law provides only quarterly or monthly periods.

For this reason, the TEAC has declared invalid all provisional assessments of Tax Management and Inspection reports studied the calendar year as the VAT accounting period, seeing as "unacceptable" the practice.

According to the collective, the amount affected by the revocation shall be broken down into 3,500 million relating to payments made to enter, as well as reducing returns and compensation, and 1,600 million of the invalidity of disciplinary proceedings related to these settlements.

As a result of this anomaly, Gestha says that the tax should be revoked, records "flawed ", return penalties and amounts paid and, if necessary, return the checks as the legal standard quarterly or monthly.

In this sense, the group considers this situation "difficult to carry out", since the current distribution of powers of the tax firm's concentrated in very few cases, and will be "very difficult" test 2009 and redo all the assessments of previous years before prescribing.

In addition, technicians say that the processing of the check of VAT for the year 2009 has been paralyzed by the Agency to the pending change the software adapted to the criteria established by the Economic and Administrative Tribunal.

According Gestha, the ruling of this Court supports the allegations that the group has been doing for years the authorities of the Ministry of Economy and Finance on the risks of having "incorrect criteria and anomalies "in the allocation of powers that affect the tax .
